Returns/exchanges are governed solely by our Refund Policy (if applicable and as published on our website).

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, force majeure events, or circumstances outside our reasonable control.

Unless otherwise required by applicable law, title and risk of loss pass to you upon transfer of products to the carrier.

“Scalebound Marketing Solutions” and related marks are proprietary. Shopify marks are owned by Shopify. Other names/marks belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to third-party tools we do not control. Such tools are provided “as is” and “as available” without warranties, representations, or endorsements.

Your use of third-party tools is entirely at your own risk and subject to the third party’s terms.

Future features and tools added to the Services are also subject to these Terms.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Scalebound is powered by Shopify, which enables us to operate the Services. However, transactions are between you and Scalebound. Shopify is not responsible for products/services sold by Scalebound or related claims, damages, or losses arising from your transactions with Scalebound.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, exclusions apply to the fullest extent permitted by law.

SECTION 16 - LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCALEBOUND, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SERVICE PROVIDERS, OR SHOPIFY AND ITS AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE DISCLAIMED, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APPLICABLE PRODUCT/SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $100.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Scalebound, Shopify (where applicable), and their affiliates, officers, directors, employees, agents, licensors, and service providers from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:

Your breach of these Terms;

Your misuse of the Services;

Your violation of law or third-party rights.

SECTION 18 - SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions remain in full force and effect.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver of that right or provision.

These Terms, together with policies referenced herein, constitute the entire agreement between you and Scalebound regarding the Services and supersede prior agreements/communications on the same subject.

SECTION 20 - ASSIGNMENT

You may not assign these Terms without our prior written consent. We may assign these Terms, in whole or in part, without notice, including in connection with merger, acquisition, or sale of assets.

SECTION 21 - GOVERNING LAW AND VENUE

These Terms are governed by the laws of Mexico, without regard to conflict-of-laws rules. You and Scalebound agree to submit to the competent courts of Mexico City, Mexico, unless otherwise required by mandatory consumer protection law.

Headings are for convenience only and do not affect interpretation.

SECTION 23 - CHANGES TO TERMS

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Services after updates constitutes acceptance of the revised Terms, to the extent permitted by law.

By opting in to receive SMS from Scalebound, you agree to the following SMS Program Terms.

Scalebound Customer Care SMS

Program Description:
SMS may include customer-care messages related to your inquiry or active project, such as inquiry confirmations, follow-up messages, scheduling coordination, service-related updates, and project updates.

Nature of Business and Customer Care Use Case:
Scalebound Marketing Solutions provides business services such as website design, branding, employee handbooks, sales training, and other business support services. This SMS program is limited to customer-care communications directly related to a user’s inquiry, requested service, scheduling, follow-up, support, or active project.

This SMS program does not use the optional website-form SMS consent for marketing or promotional text messaging. Any future marketing SMS program would require separate express written consent, separate disclosures, and, if applicable, a separate campaign registration.

How to Opt In:

No Third-Party Lead Generation:

This SMS program is not related to third-party lead generation. Scalebound Marketing Solutions only sends customer-care SMS to users who contact us directly through our own website forms and voluntarily opt in through the optional unchecked SMS checkbox. We do not purchase, rent, scrape, or obtain third-party leads for this SMS program.
